[News] European Court of Justice rejected the EU tartaric acid industry’s appeals

In February 2016, Hangzhou Bioking won the appeal about EU’s tartaric acid industry’s anti-dumping. European Commission terminated anti-dumping investigation without prejudice. However, the EU’s industry refused to accept and submitted a case to General Court of the European Union (Case No.: T-211/16). In March 2018, it lost in the first trial. The EU’s industry then submitted a case to European Court of Justice (Case No.: C-345/18). On July 10, 2019, the lawsuit was rejected. Then, European Court of Justice exempted Hangzhou Bioking of anti-dumping again.


Review of the anti-dumping case:


First anti-dumping: In 2004, Bioking was involved in the appeal to the EU’s Anti-dumping in China. In 2006, it won in the anti-dumping case with zero tax rate. The products were directly exported to famous food enterprises in Europe.


Second anti-dumping: In 2012, Bioking won in the anti-dumping case with zero tax rate for the second time. The sale of the products continued increasing.


Third anti-dumping: In 2016, Bioking won in the anti-dumping case with zero tax rate for the third time.


Hangzhou Bioking actively responded to the appeals in the anti-dumping case. With relentless efforts and international lawyers’ assistance, from a small enterprise to a bigger one, Bioking has become more powerful. Anti-dumping is a challenge and opportunity for the enterprise. Three consecutive victory in anti-dumping case made Bioking the only tartaric acid export enterprise to the EU with “zero tax rate”, thus effectively ensuring fair trade in Europe. Besides, it showed that Chinese manufacturing enterprise’s active response to WTO disputes and braveness to challenge non-market rules in WTO dispute solution mechanism, and sound achievements were made. Bioking’s three victories in anti-dumping case were rare among domestic manufacturing enterprises. Therefore, it sets an example for Chinese manufacturing enterprises to obtain a fair status in world trade. It is of crucial significance, far beyond the enterprise itself. Bioking’s active response to anti-dumping and the precious experience were sung highly of by the business departments in the province, city and district.
